Is the large chain pharmacies getting out of filling controlled med Rxs ?

Here is the SMOKING GUN to prove civil rights violations – could support a class action lawsuit – but the community needs to stand up

Above is a post that I made just a couple of days ago and below is a quote I saw on the web, don’t know what city this is happening in, but this would appear to be the actions/reactions of one or more chain pharmacies to the recent HUGE FINES that these chains agreed to because without admitting to any guilt – agreed to pay BILLION OF DOLLARS because of being part of the contribution to the fabricated opioid crisis. It would appear that chronic pain pts are going to be the collateral damage of this “social” war on drugs/pts.  This could be the FIRST SHOE of many shoes that will drop.  Use this phrase in a search engine to find the law firms “law firms and class actions civil right Americans with Disability Act”  If you are waiting for GEORGE TO DO IT –   George is NOT COMING TO HELP YOU !

If you don’t believe that healthcare is nothing more – nothing less than a PROFIT DRIVEN INDUSTRY.  Pay attention to the graph below,  look at the average GROWTH of these major healthcare entities REVENUE. Remember that United Health is endorsed by AARP and what article I have read in AARP publications, they are mostly in lock step with the DEA and others believing that prescription opiates are the genesis of the fabricated opioid crisis.

 

Every preferred pharmacy has let my pain management practice know that they are no longer accepting prescriptions from their practice. I originally thought this was just my pain management practice but after speaking to other pain patients in our area who see other pain management doctors or practices they have run into this same issue. All the work spent in open enrollment to figure out where best to get medications was all for naught since I am no longer receiving discounts for a preferred pharmacy and worse trying to find pharmacies that will accept and fill your prescriptions are few and far between and most requiring that all your medications be filled by them no matter the cost that you as a patient have to pay. Someone said it was due to the suits discussed here and these bigger pharmacies and chain pharmacies just are not accepting or filling prescriptions that can set them up for additional settlements or suits in the future.

From 2021 to 2022, the big 5 payers got even bigger.

In order, here’s their 2022 revenue:
– UnitedHealth Group: $435B
– CVS: $367B
– Cigna: $181B
– Elevance Health: $180B
– Humana: $93B

Whether you like it or not, these plans (along with the large BCBS plans and Kaiser) dominate health insurance.

The fundamental problem with health insurance as a pure business is that it is low margin (due to MLR and ALR requirements), hard to scale, and has high capital costs (i.e., risk-based capital requirements).

Since 80-85% of the cost is guaranteed to go into medical spend (although some reclassification of expenses exists), it only makes business sense for payers to launch provider services.

To some degree, they are able to double dip profits, first from the plan perspective and then from the provider side.

Now the question remains, will doctors use services rendered by payer entities? I know many doctors who prefer not to refer to these subsidiaries, because they often battle with the payer over prior auth and rate negotiations.

Regardless, bigger ideas are coming. Who is next and what will they buy?

  1. I’m a bit confused are you thinking the companies like Walgreens will just refuse to fill any controlled substances? Or do you think the players like Express Scripts want all rx funneled through their businesses

    • that is what I understand that was part of that agreement Walgreen, CVS & Walmart made with the 50 AG’s, native American Reservations and others.. Here is the SMOKING GUN to prove civil rights violations – could support a class action lawsuit – but the community needs to stand up I did not read the nearly 600 pages but did some word searches and copied/paste what I consider important paragraphs. In reading these paragraphs, these wholesalers, don’t know the pt, the prescriber, all they know is that a properly licensed pharmacy is ordering the various opioids. Currently the DEA raids prescriber’s offices based on some statistic that the DEA has determined that the prescriber is a “OUTLIER ” of other similar prescriber practices. I suspect that the wholesalers will try and stay under the potential trigger number that would get DEA’s attention and just like the DEA’s pharma controlled meds production quotas that have been reduced annually for nearly a decade.

  2. I’m ALL FOR A CLASS ACTION SUIT for a serious Human Rights violation and will be looking up lawyers this evening. I haven’t been on FB much lately because I got tired of having suggestions, only to be ignored because nobody will call anyone! I want my LIFE back and to be able to take care of my house and husband like he’s taken care of me the last four years. I’m not sure how to go about it but want to find out. This genocide has to stop! I’m so mad because everything is about OUD, which is a fancy name for addiction. They’re worried about their deaths but not ours!

    I’ll check out APDF, which I think has done so much for us. If there are 50 AG’s gunning for our MEDICATIONS, will we be able to beat them? I know for a fact that Ohio’s AG LIED to me about the opioid settlement money they got in 2018-19, because he told me two different things within six months. Both can’t be true.

    If we can find a good lawyer, will everyone get involved? Stop crying about your pain if you won’t do anything to make it better! A Civil Rights lawyer sounds like a great start.

    • all it will take is 1-2 lead plaintiffs for a class actions.. the community doesn’t have to go after the AG’s, they have the protection of sovereign immunity the community needs to go after all those large healthcare corporations that have agreed to reduce the community’s pain management. the Pharma’s, drug wholesalers, large chain pharmacies have no prescriptive authority, and don’t have the legal authority to agree to limit, deny any pt’s pain management. these corporations have paid out BILLIONS and BILLIONS of dollars – while admitting no guilty – for participating in creating the fabricated illegal fentanyl crisis. Maybe if the community could get into those “deep pockets” for civil rights discrimination of untold number of people in the chronic pain community. Maybe they may find some $$$ to put into their lobbying budgets to help get either the DEA muzzled or the CSA revoked or greatly amended to get the DEA out of prescriber’s offices and following the Ruan/KAHN SCOTUS June 2022 ruling. Maybe it is time that they don’t just fold to the legal bullies that are determined to rip away pain management from everyone in the community. I will be more than happy to talk to any law firm that is interested and help them draw a road map to a large pot of money

      • I didn’t find anyone last night but our daughter and her family came over and took us to dinner. I went, but wasn’t even able to give a bottle to my 11# grandson because of my neck and shoulder pain. I’m missing out on everything that has to do with family and I miss it.

        I’m going to look today but might need some coaching. I’m willing to borrow from home equity if it’ll restore my life! Not pay for all of it but I’d hope others would be able and willing to help financially. I certainly hope another person will be the second lead plaintiff! If not, we’re out of luck. Steve, I’ll message you if I find someone, if that’s okay. I’ve never had any experience with lawyers or lawsuits so I’m flying blind but I’m going to do it. It’s either that or keep praying for death.

        • with the number of potential pts being discriminated against… a serious law firm should be willing to take the case on a contingency basis… no money needed up front

          • I sent messages to 4 law firms in Ohio and got zero responses. Usually with things like that, my phone’s ringing before I’m done. There are more, I just have to try again tomorrow. I’m counting on you, Steve, to coach me through this if I get a response. I’ve never been in the legal system but I’m not going to quit. There has to be somebody out there that will take our case. There should be a big payout for as many of us there are. I’m also afraid they’ve all been brainwashed against these terrible killer drugs.
            The jerks that came up with all of this a decade ago had everything planned. THEY need to feel severe pain for a full year, to get the full effects of all the seasons and weather changes.

  3. I’ve warned people that if they don’t learn what I teach–the REAL cause of drug abuse–and work to get the CSA (controlled substance act) repealed, there will be no opioids by 2030. So this doesn’t surprise me at all. It’s just a warning shot. So when there are no opioids, don’t start crying. You’ve been warned. The way to stop this is still available, however.
