Georgia Homeowner Killed in Fruitless Drug Raid

http://stopthedrugwar.org/chronicle/2014/oct/04/georgia_homeowner_killed_fruitle

From the article:

A Georgia SWAT team shot and killed an armed homeowner during a September 24 drug raid sparked by the word of a self-confessed meth addict and burglar who had robbed the property the previous day. No drugs were found. David Hooks, 59, becomes the 34th person to die in US domestic drug law enforcement operations so far this year.

The search warrant to raid Hooks’ home came about after a local meth addict named Rodney Garrett came onto the property two nights earlier and stole one of Hooks’ vehicles. Garrett claimed that before he stole the vehicle, he broke into another vehicle on the property and stole a plastic bag. Garrett claimed he thought the bag contained money, but when he later examined it and discovered it contained 20 grams of meth and a digital scale, he “became scared for his safety” and turned himself in to the sheriff’s office.

Garrett’s claims were the primary basis for the search warrant. But investigators also claimed they were familiar with the address from a 2009 investigation in which a suspect claimed he had supplied ounces of meth to Hooks, who resold it. Nothing apparently ever came of that investigation, but the five-year-old uncorroborated tip made it into the search warrant application.

And it was enough to get a search warrant from a compliant magistrate. Hooks family attorney Mitchell Shook said that even though the warrant was not a no-knock warrant, the Laurens County SWAT team did not announce its presence, but just broke down the back door of the residence.

Several shots were fired through a blind wall at David with the shooters not knowing who or what was on the other side of the wall. The trajectory of the shots, coupled with the number of shots infers a clear intent on behalf of the shooters to kill David Hooks.

after the shooting, the Georgia Bureau of Investigation conducted an intensive 44-hour search of the property and came up with not one item of contraband.

I know that S.W.A.T stands for special weapons and tactics … I guess they couldn’t find a good word that included ILLEGAL TACTICS ?

Another issue of helping a pt to BE WELL ?

stevemailboxMy brother’s wife just had a C-section in Kissimme FL,  and he was looking to fill his for his wife’s discharge medication, Oxycodone/APAP 5/325 #30. He was turned away from a couple pharmacies, so he called me, saying: “Hope you have some pharmacist back door before I have to do the whole pharmacy crawl” (his words). He has a discharge script from a local hospital, for a common drug that isn’t a high quantity, and had enough trouble filling it he called me from out of state, hoping he wouldn’t have to go from pharmacy to pharmacy.

Unfortunately, my chain isn’t in Florida, so I can’t look in the system on who was it. I called the local Walgreens pharmacist who I know, but their system will not allow her to access CII inventory in another store. I had to look up on their web site to find a store close by, call it, reach the POWER center and get transferred to the store and speak to the pharmacist to find if they had a common drug to direct my brother to.

(Called Walgreens, because besides all their problems, still better then the evil that is CVS. I wouldn’t send them business if I can help it)

My brother had family issues, so wasn’t able to go out to the pharmacy tonight that I found had the drug… I’ll see if he has problems tomorrow.

I knew there was a problem filling CII’s in FL, due to the pill mills, and all the pharmacies being scared of the DEA, but didn’t realize is was so bad that enough pharmacies refused to fill generic Percocet 5/325 #30 from a hospital discharge that a family member would call out of state for help.

Is torture inflicting pain on another person…. or… is it allowing a person to remain in pain ?

I guess the Pharmacist Oath… has been revoked in Florida ?

“I promise to devote myself to a lifetime of service to others through the profession of pharmacy. In fulfilling this vow:

  • I will consider the welfare of humanity and relief of suffering my primary concerns.
  • I will apply my knowledge, experience, and skills to the best of my ability to assure optimal outcomes for my patients.
  • I will respect and protect all personal and health information entrusted to me.
  • I will accept the lifelong obligation to improve my professional knowledge and competence.
  • I will hold myself and my colleagues to the highest principles of our profession’s moral, ethical and legal conduct.
  • I will embrace and advocate changes that improve patient care.
  • I will utilize my knowledge, skills, experiences, and values to prepare the next generation of pharmacists.

I take these vows voluntarily with the full realization of the responsibility with which I am entrusted by the public.”

Can’t happen too soon !

Doctors have no idea how much their patients are suffering. That’s about to change.

Ebola: Obama Names ‘Czar’

http://www.medpagetoday.com/InfectiousDisease/Ebola/48131?isalert=1&uun=g578717d2380R5705800u&utm_source=breaking-news&utm_medium=email&utm_campaign=breaking-news&xid=NL_breakingnews_2014-10-17

From the article:

President Barack Obama has asked Ron Klain, a former chief of staff to Vice-President Joe Biden, to coordinate the administration’s response to Ebola.

Klain, a lawyer and Democratic party insider, also was chief of staff to former vice-president Al Gore and was deeply involved in the recount battle during the 2000 presidential election.

IMO.. that is last thing that we need is a person WITH NO MEDICAL EXPERIENCE … over seeing a medical crisis…

I guess that connections within the Democratic Party is more important than their back ground.. when finding someone to oversee this medical crisis..

Gives me the “warm fuzzies ” 🙁

Who wants to be responsible for destroying pt’s controls ?

mousetripDisposal of Controlled Substances

https://www.federalregister.gov/articles/2014/09/09/2014-20926/disposal-of-controlled-substances#h-87

From the article:

[10] Issue: One commentor asked the DEA to clarify the phrase “causes the destruction” as it could be interpreted to mean any person involved in the process.
Response: As previously discussed, proposed § 1317.100 is relocated in this final rule to § 1304.21(e). The DEA included the term “causes the destruction” to encompass such circumstances where a registrant does not itself destroy the controlled substance but is still responsible for the destruction;

also: [another example of DEA’s vague answers when asked for guidance, how comforting]

12] Issue: One commenter noted that the DEA used inconsistent time requirements throughout the proposed rule, such as “timely,” “prompt,” and “as soon as practicable, but no later than 14 days.” Additionally, several commenters requested clarification regarding the definition of the word “prompt” in the proposed rule, and commenters asked for clarification regarding how the DEA would determine whether an action is “prompt.” Commenters asked for guidance as to what time range the DEA would find reasonably acceptable.

Response: The DEA’s use of different time standards throughout the proposed rule was intentional as the different circumstances of each requirement warrant different standards. The various timing requirements are intended to be flexible enough to account for individual circumstances while also ensuring sufficient and adequate controls to prevent diversion and opportunities for diversion. The DEA considered imposing specific timelines (e.g., three days, five days); however, the wide variety of business models and activities made it impossible in most circumstances to set a specific deadline that would prevent diversion and diversion opportunities. Additionally, violations of specific timelines would be per se violations of the regulations, whereas violations of the flexible “prompt” and “as soon as practicable” standards would be considered under each registrant’s individual circumstances. The DEA’s determination will be guided by whether the registrant has fulfilled its responsibility to provide effective controls and procedures to guard against theft and diversion. Emoji

There are many more potential hangups and such with issues like storing/collecting meds until ready to send out for ‘destruction’. Questions about shipping all done through USPS who unlike recent, hesitant drug warriors UPS and FEDEX, they are NOT able to inspect/search a package w/out a warrant.

baithookHow wonderful of the DEA to give us the opportunity to take on another “free task” and having to account for these controls and their destruction.

The DEA and TRANSPARENCY ?

Earlier in 2014 the Supreme Court ruled that citizens can film/photograph law enforcement at any time…
Apparently these DEA agents understand that ruling… but has little regard for transparency and personal space..

Modern Technology used in drug diversion ?

BUSTED! 51 arrested and charged, accused of manufacturing fraudulent prescriptions & filling them

From the article:

The U.S. Drug Enforcement Administration announced Thursday, October 16th state and federal charges against 51 people in total related to the illegal distribution of pharmaceutical controlled substances in the Milwaukee metropolitan area.

“The Brown Maki organization is alleged to be responsible for producing approximately 196 fraudulent prescriptions accounting for over 25,000 oxycodone pills,” Milwaukee County District Attorney John Chisholm said.

You notice that there no mentioned of any pharmacy involved in filling all 196 of these fraudulent Rxs. So does this mean that these pharmacies have 25,000 doses unaccounted for… because of the fraudulent Rxs ?  Is that more DEA fines just waiting to be imposed ?

OR

Since this investigation went on for abt ONE YEAR… the DEA knowingly allowed C-II opiates to get to the street… so that they could build their case ? So they could have been contributing to some over dose deaths… in order to build the case ? I would guess that their mission is more important than the life of  numerous addicts/junkies.. that OD’d ?

Collateral damage Walgreen’s/Boots Alliance merger ?

Ex-CFO Sues Walgreen Over Reports He Was Forced Out

http://www.bloomberg.com/news/2014-10-16/walgreen-ex-cfo-miquelon-sues-company-for-defamation.html

From Article:

Former Walgreen Co. (WAG) finance chief Wade Miquelon sued the drugstore giant for defamation over news stories saying he was pressured to resign after a “bungled” earnings forecast.

Miquelon, 49, sued Walgreen today in state court in Chicago, claiming Chief Executive Officer Gregory Wasson and director Stefano Pessina, the company’s biggest shareholder, made false, disparaging comments about him to a Wall Street Journal reporter after he stepped down as CFO Aug. 4.

Miquelon said the executives’ defamatory remarks led to two stories claiming he made a calculation error that caused a $1.1 billion reduction in the company’s fiscal 2016 earnings forecast.

As a result of the reports, Miquelon said, he lost opportunities to work as a chief financial officer for another Fortune 100 company. Miquelon said he had been considered to serve as CFO and president of “a major global retailer.”

Don’t you just love it when the “BIG BOYS” duke it out ?

blindjusticeCompounding Pharmacist Pleads Guilty to Paying Kickbacks for Referrals, Health Care Fraud Offenses

http://www.fbi.gov/newark/press-releases/2014/compounding-pharmacist-admits-paying-kickbacks-for-referrals-health-care-fraud.

From the article:

CAMDEN, NJ—A pharmacist with a compounding pharmacy in Lakewood, New Jersey, admitted today to paying tens of thousands of dollars in cash bribes to physicians for referring pain cream prescriptions, defrauding health care benefit programs out of hundreds of thousands of dollars, U.S. Attorney Paul J. Fishman announced.

During his guilty plea proceeding, Kleyman admitted that in a series of meetings in November and December 2013 alone, he arranged for the middleman to receive more than $40,000 in cash or checks with the understanding it would be used to pay bribes for the referral of pain cream prescriptions.

The conspiracy count with which Kleyman is charged carries a maximum potential penalty of five years in prison and a $250,000 fine. The government is also seeking Kleyman’s forfeiture of any proceeds derived from his offense. Sentencing is currently scheduled for Jan. 20, 2015.

It is strange… you never see anyone going to jail.. when one of the large public corporations get tagged with Medicare/Medicaid fraud. I know that it is debatable if a corporation is a person or not.. but.. either way… there is someone in the E-suite.. that is calling the shots… that caused the Medicaid/Medicare fraud…

Justice may be blind.. but.. not always equal !!
