New Hampshire Right to Life [NHRTL] is dismayed that the NH Supreme Court continues to deny citizens the right to sue state agencies who act illegally. NHRTL had sued over the Board of Pharmacy’s failure to enforce basic FDA safety protocols which are required under NH statutes. The Board of Pharmacy did not deny that it was acting unlawfully or that allowing distribution of dangerous pills was putting women’s health at risk, but asked the Court to dismiss the petition on ‘standing’ grounds.

Last week, the Supreme Court sided with the Pharmacy Board and denied the people of NH have any right to demand the agency enforce NH law regarding unlawful granting of drug distribution licenses to Planned Parenthood. This decision allows any state agency to flagrantly violate the law with no possibility of taxpayers challenging that action in court.

The paper explains: “Using a law designed to catch drug traffickers, racketeers and terrorists by tracking their cash, the government has gone after run-of-the-mill business owners and wage earners without so much as an allegation that they have committed serious crimes. The government can take the money without ever filing a criminal complaint, and the owners are left to prove they are innocent. Many give up.”
“Last year, banks filed more than 700,000 suspicious activity reports. Owners who are caught up in structuring cases often cannot afford to fight. The median amount seized by the IRS was $34,000, according to the Institute for Justice analysis, while legal costs can easily mount to $20,000 or more.”
The DEA’s version of this confiscating a innocent’s person money is called

civil forfeiture – guilty until proven innocent

On Cavuto today judge Andrew P. Napolitano discussed these civil forfeiture laws and in his opinion… Congress passed these laws and they are UNCONSTITUTIONAL..

In thinking how the DEA and the IRS works.. the large companies gets fines.. no forfeitures .. so they can’t challenge the law..  The people they use the forfeiture laws against… are drug dealers… that are criminals.. and small business person.. that once the DEA or IRS seizes all their assets.. they have nothing left to even defend themselves.. let alone challenge the legality of the forfeiture law..

Abraham Lincoln said, “that this nation, under God, shall have a new birth of freedom — and that government of the people, by the people, for the people, shall not perish from the earth”,

I think that this phrase has been changed… “government of the bureaucrats, by the bureaucrats and screw the people !  But I may be wrong…

Yesterday I wrote about Indiana Mayors calling for all cold medicines are available as Rx only.. I stated my opinion that this was just more bad processes of what is already in place. They mentioned that both Mississippi and Oregon had similar laws.. Missing was the fact that those laws in those two states.. ARE NOT WORKING.

Thanks to some of my readers.. I got the following…

I live in Mississippi and we have a METH problem. We have had this problem for years. The first thing that impacted me as a pharmacist was having to put PSE products behind the counter and then get patients to sign to buy it. That did not seem to be enough, so PSE products are prescription only in the state. This has been in effect for about 2 years. But, we still have a METH problem.

Study: Cold medicine law isn’t reducing meth use in Oregon

If this Rx only process is failing in these two states.. what makes this group of mayors believe that it will be successful in Indiana ?
Can’t you remember as a kid arguing that you wanted to do something and claimed that “everyone else is doing it “… which your parent replied “if Johnnie jumped off the bridge…would you want to jump off the bridge”..
I may be wrong… but it has been stated that 80% of the meth in this country comes from south of the border.. so as long as our southern border is WIDE OPEN… we are going to continue to have a meth problem ?
Maybe my logic is faulty.. but if law enforcement/Congress/Administration was serious about addressing our “meth problem”.. they would focus resources on CLOSING OUR SOUTHERN BORDER.  Since they are not addressing the southern border… are they just interested in perpetuating this war on drugs..?

magicianI kind of makes you wonder how many times these bureaucrats are going to pull another “rabbit” out of their hat.. to try and put a halt to substance abuse. It is reported that 80% of the Meth in this country comes from south of the border… so restricting the sales of PSE products is going to impact its availability how ?

This is a system that many states use as a national database to collect sales of PSE products..  Of course this system does not validate the driver’s license that is presented to the pharmacy.. So passable fake driver’s license goes into the system. IMO.. this system is so lame that if the driver’s license presented has been accepted by another pharmacy at some point in time.. once the pharmacy staff enters the driver’s license into the system.. the balance of the data points self populates.. and confirmation bias kicks in for the pharmacy staff.

This might explain that after using this system in Indiana for several years… it leads the country in Meth lab busts and continues to grows. Indiana also at the top of the list of pharmacy robberies.

The Indiana AG ( Greg Zoeller) keeps trying to bring out new programs.. like his bitter pill program  http://www.in.gov/bitterpill/ to curtail the abuse of legal/illegal medications and other substances.

Maybe, if these bureaucrats would seek out those within healthcare as to how to address these issues … perhaps some progress could be made.. you are never going to eliminate all the abuse of some substances… just like you are never going to be able to close down all the jails and prisons.

But then we are working under the presumption that they are really trying to make progress.. or could they just going thru some motions and press releases to make the public believe that they are trying to make progress and in reality all they are trying to do is keeping the status quo and job security for those involved in fighting this war on drugs ? Why else would be fighting this war for ONE HUNDRED YEARS ?

Why don’t you just mind your own business ?

Nevertheless, the FDA sent Diamond Foods a very touchy, personal letter, aggressively stating that:

“Your walnut products are drugs…they may not legally be marketed in the United States without an approved new drug application.”

The last thing this country needs is to classify natural, healthy foods as drugs. With the bad rep around prescription drugs that have been pushed out by the FDA, putting healthy foods into the same category would just be an insult. After all, you don’t up your risk of ulcers or heart attacks with natural, organic fruits and vegetables – something that can’t be said for a number of the other products that the FDA labels as “drugs.”

Despite Diamond Foods being backed up by evidence that supports the benefits of eating walnuts, the FDA told them that their products were “misbranded.” Basically, the FDA didn’t like that a company was promoting health claims that they didn’t approve of – regardless of the scientific support.

But even then, the agency threatened Diamond Foods with a possible “seizure” if they did not comply with the warnings they set out. Below is an actual excerpt from the letter that Diamond Foods received:

“We have determined that your walnut products are promoted for conditions that cause them to be drugs because these products are intended for use in the prevention, mitigation, and treatment of disease… are offered for conditions that are not amenable to self-diagnosis and treatment by individuals who are not medical practitioners; therefore, adequate directions for use cannot be written so that a layperson can use these drugs safely for their intended purposes.”

Addiction is a DISEASE – imagine that !

Even if it did, it would still spend seven times less on treatment than it does on a prison system that holds thousands of people whose offenses are directly tied to addiction.
So if addiction is a DISEASE… why do we keep throwing them in prison ? I don’t see our society throwing other people in prison because they have a chronic disease. The question has to be asked.. why is our legal system discriminating against this segment of our population which is probably covered by The Americans with Disability Act ? Isn’t this a Human Rights issue similar to what we criticize other countries about .

They claim that overdose deaths by drugs has increase FOUR FOLD in a similar time frame…

Since she was the only cashier on duty, everyone in the store who bought anything, including the vulnerable senior citizens, had to visit her register and presumably get exposed to whatever illness she has. I felt so sorry for her, since she still had several hours left in her shift.
