Sad story at the hands of FLORIDA’S legal system


I remember exchanging emails with Siobhan years ago before her unfortunate demise in a small airplane crash being flown by her boyfriend/fiance

Her husband Richard Paey was convicted of selling drugs.. with no solid evidence… it was reported that law enforcement told the prescriber that if he didn’t deny writing the Rxs for the opiates.. they would go after him… there was reportedly a Pharmacist.. who filled these Rxs… testify at Paey’s trial that he had called the prescriber before filling each..

It was reported that when in prison… they provided Paey.. with a implanted morphine pump and provide him with much more opiates than he was convicted of possessing … in order to properly management his pain..

There was even a report that law enforcement threatened to let his pump RUN DRY.. if he didn’t do, not do or admit something.. can’t remember.. too many years ago of the details.

Another vivid example of our judicial system.. that winning is everything… no matter what it takes…

Smith Corporation, the Harvard Drug Group, Anda Inc., Associated Pharmacies Inc., Auburn Pharmaceutical Company, H.D. Smith Wholesale Drug Company, Keysource Medical Inc., Masters Pharmaceuticals, Quest Pharmaceuticals, Richie Pharmacal Co. and Top RX Inc. have substantially contributed to and substantially, illicitly and tortiously benefitted financially from the prescription drug abuse problem in West Virginia.

The defendants distribute various prescription drugs that are closely identified with the prescription drug problem in West Virginia and were on notice of the growing epidemic from the abuse of the prescription drugs, according to the suit.

The Attorney General’s Office claims the defendants are major distributors of controlled substances and have supplied the prescriptions to drugstores, which then dispense controlled substances based upon bogus prescriptions from physicians who are prescribing controlled substances for illegitimate medical purposes.

“Throughout their acts and omissions, these defendants have inserted themselves as an integral part of the pill mill process,” the complaint states.

So if you are a Drug wholesaler licensed to legally sell control substances to pharmacies that are licensed to legally to fill prescriptions .. written by legally licensed prescribers. And even though you have no knowledge of the prescriber that wrote the prescriptions and no knowledge of the patient that purchased the prescriptions…  you have contributed to abuse of prescriptions…? When are they going after the insurance companies for paying for these meds and the Brand Name Pharma’s that produce the drugs.. and finally the US troops that help guard the poppy fields in Afghanistan. So the original source of the problem is our Federal Government ?  Nothing like being both the source and solution to a problem ?

stevemailboxThis poor person asked for my help and I gave  a road map to resolve this issue..  In thinking about the potential consequences to this person because of the “professional discretion” of one Pharmacist believing that he/she was exercising correct corresponding responsibility..

This person has been a chronic painer for DECADES..  is 2 yrs from retirement … if  unable to get his/her medical necessary medication.. he/she will not only risks loosing hes/her job but also her HEALTH INSURANCE.

So this one Pharmacist has potentially thrown this one person’s physical/financial life … into the CRAPPER !

One of my suggestions was to hire an attorney and send a letter to WAG’s legal… putting them on notice that this person is going to seek legal regress … if the decision of that one pharmacist causes the loss of employment.  I suspect that if this proceeds to court.. the individual pharmacist will get sued as well…

Do I have any recourse in getting my prescription for hydrocodone filled, since Walgreens refused to fill my legal prescription?  Now no pharmacy will fill it
I am a school teacher who began teaching in  Flordia back in 1984.  I have had severe arthritis since my late 20s (I am a petite woman) and have had to be on pain medication for many years.  I have tried to take every new non-opiate medication that comes out, but because of a gastrointestinal issue have had bad reactions to all the medications and have had to revert to the hydrocodone every time.
I am 63 years old and have been a productive member of society for my entire life.  Now I am faced with the possibility, almost certainty, that I will have to retire before my retirement benefits are fully invested because I am in so much pain and I am struggling to get around, much less be in a classroom with 30 students all day, every day.
What recourse do I have?  I need this medication to function;  I am not a drug addict.
Please help me.

    Success!  Walmart called me back and apologized for not filling it in the first place.  This, however, did not happen until I emailed Walgreens, CVS, and Walmart with my intentions, and after I had followed your instructions.

Thanks, Steve.  I already did file an ADA complaint and one with the Board of Pharmacy.  I cc’d Walgreens, CVS and Wal-Mart my exact words from those complaints.  I suspect that is what got their attention.  I am not going to let this go away.  As you said, it may help someone else.

Pharmacist Fired, Facing Charges

A pharmacist at Wal-Mart Supercenter, Walton Boulevard, Warsaw, could be facing criminal charges for theft of medication.

According to Warsaw Police Lt. Kip Shuter, officers were called to the store at 5:29 p.m. Monday, after the pharmacist was fired and escorted off the property. According to store loss prevention officials the theft occurred Oct. 29.

Police were told a technician in the pharmacy had discovered medications were getting mixed. A video showed the pharmacist placing two separate medications in the same medicine container. The pharmacist allegedly stole 40 tablets of ciprofloxacin, an antibiotic, valued at $8.

Information on the matter has been sent to the Kosciusko County Prosecutor’s office for further review.

This story is so THIN on details…  How did medications were getting mixed… to theft of Ciprofloxacin ? Will the truth every surface on this issue…?

And you thought that “wish lists” were limited to retail internet sites ?

The seminars offered police officers some useful tips on seizing property from suspected criminals. Don’t bother with jewelry (too hard to dispose of) and computers (“everybody’s got one already”), the experts counseled. Do go after flat screen TVs, cash and cars. Especially nice cars.

It is difficult to tell how much has been seized by state and local law enforcement, but under a Justice Department program, the value of assets seized has ballooned to $4.3 billion in the 2012 fiscal year from $407 million in 2001. Much of that money is shared with local police forces.

In the Georgia session, the prosecutor leading the talk boasted that he had helped roll back a Republican-led effort to reform civil forfeiture in Georgia, where seized money has been used by the authorities, according to news reports, to pay for sports tickets, office parties, a home security system and a $90,000 sports car.

But in the video, Mr. McMurtry made it clear that forfeitures were highly contingent on the needs of law enforcement. In New Jersey, the police and prosecutors are allowed to use cars, cash and other seized goods; the rest must be sold at auction. Cellphones and jewelry, Mr. McMurtry said, are not worth the bother. Flat screen televisions, however, “are very popular with the police departments,” he said.

Prosecutors boasted in the sessions that seizure cases were rarely contested or appealed. But civil forfeiture places the burden on owners, who must pay court fees and legal costs to get their property back. Many seizures go uncontested because the property is not worth the expense.

Mr. McMurtry said his handling of a case is sometimes determined by department wish lists. “If you want the car, and you really want to put it in your fleet, let me know — I’ll fight for it,” Mr. McMurtry said, addressing law enforcement officials on the video. “If you don’t let me know that, I’ll try and resolve it real quick through a settlement and get cash for the car, get the tow fee paid off, get some money for it.”

Prosecutors estimated that between 50 to 80 percent of the cars seized were driven by someone other than the owner, which sometimes means a parent or grandparent loses their car.
