Hell’s fury is just about to be unleashed in Ohio. Effective 3/1/15, Medicaid is now going to block certain pharmacies from filling Medicaid funded prescriptions…. This will the first time ever we will have to tell customers we do not take their plan. This directly affects me because my child is United Healthcare, I am not happy… I can no longer use my own pharmacy to fill his prescriptions if I want them paid. This could adversely affect tech hours as it is going to be a sucker punch to our business.

I am not kidding when I say I just spoke to a doctor’s office who told me I have to interview with their scheduling office for them to determine if they will take me as a client… it is because they are no longer taking Caresource, Buckeye and other Medicaid funded insurance plans. I have insurance through my employer which is a privately funded third party so they would be happy to have me as a new patient.


 

The fed funding for state medicaid expansion was ended on december 31. States will collectively be experiencing no less than a 720 billion dollar shortfall. My guess is this why your pharmacy was eliminated. It would be sweet irony if all 50states did this to the big 3chains. Maybe they would think twice before supporting crap legislation like obamacare next time

Today I had a patient JH, who presented with vomiting and flank pain, hydronephrosis on ultrasound and blood in the urine. He was clearly having a kidney stone. He was miserable, and ill. On no previous prescriptions.
Otherwise healthy guy 65 years old. I ordered him multiple medications including Percocet tens. He’s going on a cruise in three days for his 45th wedding anniversary.

When his wife went to Safeway to pick up the prescriptions, she was told “this doctor is prescribing medications illegally. We won’t fill this. The wife came back to Urgent Care Plus and she was upset and irate.
She had never been treated so rudely to buy health facility in her life. She will be making her own complaints. She felt I had been severely libeled and slandered. I tend to agree. I believe it is time to take legal action.

I do not believe the local pharmacist will stop in there progressive formation of a lynch mob.
I think they only respond to force and right now the only force they’re getting is coming from the DEA and their corporate offices.

Let me know when we should start this process this would include CVS Walgreens Osco and Now Safeway.

I can completely relate to this man… I have had kidney stones before – they are no fun –  and working on year 46 of our marriage and I also know how expensive those cruises can be..  Under similar situation.. having to go on a cruise sick or have to skip it.. and lose all that money… Over #10 Oxycodone/APAP 10mg/325mg…  I am not sure who I would share my pain with …

Many times before I have stated that those in the chronic pain community if THEY DO NOTHING… THEY GET NOTHING… According to this one person’s post SILENCE in the chronic pain community is EPIDEMIC ! In this particular incident.. SILENCE IT NOT GOLDEN ! There are a lot of people – like myself – advocating for the chronic pain community…but.. without the cooperation of those in the chronic pain community.. at some point they will become discouraged and stop advocating for chronic painers… just like Doctors have stopped prescribing controls and Pharmacists have stopped filling controls. “they” are winning… because no one wants to have THEIR DOG in this fight !  BOTTOM LINE… if your are chronic painer… you need to put on your “big boy pants” and your “kick ass shoes” unless you prefer to be in uncontrollable pain and confined to a bed/chair/house due to your pain… just keep on doing NOTHING on your own behalf… because the DEA is not going to give up… a lot of their jobs depend on it…

Comment: Sorry you have had such a hard time w/ the grievance procedure. The CMS rep told me the same, that I should receive benefits and if I don’t I need to contact my insurance company. You need to bypass the min wage rep and demand a supervisor at the bare minimum then go to CMS and do the same thing bypass/demand.

I do have an update in regards to how my grievance procedure is going (or not going) that is rather interesting in light of what you are sharing in your post. On Dec 18 I had still not heard back from BC/BS PDP regarding my grievance which was now the >30days they guaranteed.
So. I called CMS. The rep was a joke but the supervisor I talked to took down all my information and commented that she thought I had a clear case of more than one violation w/ both the insurance company and the medical center’s pharmacies. While waiting on their computer to go through its motions there was a bit of down time. I told her that I kept up w/ all the goings on w/ the prescription drug ‘epidemic’ and the resulting patient abandonment and pharmacy refusals.
I commented that they must get these complaints all the time. She told me that this was actually the FIRST complaint she had received that was against a pharmacist!!!

Keep in mind that this was a SUPERVISOR w/ CMS; and in Dec ’14 she was processing her FIRST grievance against a PHARMACIST for refusal to fill and therefor in violation of contract w/ Medicare Part D provider?!?!?!? Unreal. Almost a direct contradiction to your experience.

Interestingly enough I received a call back from BC/BS Part D rep not 2 days after filing complaint w/ CMS, coincidence? No, she left message saying it was in regards to the complaint. So ignore til it goes ‘higher up’ must be their strategy. I Spoke w/ her on Dec 23 for an hour. She continually made excuses for the pharmacies in the medical center’s network then went on to suggest that I change to a doctor closer to home!!!!!!

I then read verbatim from their Evidence of Coverage booklet in which they claim, and repeated in their booklet ‘Annual Notice of Changes’, that say and I’ll quote:

“The Evidence of Coverage is the LEGAL, detailed description of your plan benefits. It explains rights and rules you need to follow to get covered services and prescription drugs”
She told me that there were a lot of ‘problems’ and that the hospital had ‘regulations’ blah blah blah…..I then read another section…….
and I’ll quote it “The Evidence of Coverage and applicable riders attached hereto , and completed enrollment form, constitute the ENTIRE CONTRACT between the parties and as of the effective date hereof, SUPERSEDE ALL OTHER AGREEMENTS between the parties”

Seems pretty cut and dry and that is why I imagine she then asked me if I would participate in a 3 way call between her, myself, and the PIC at the pharmacy. Stonewalled by dunce PIC and when asked about the specific ‘regs’ that limited me to use of one out of seven of the medical center’s pharmacies he said he could not divulge any information!!!! Not a surprise as I have asked several times where I can find this information in writing and been denied. My guess is it doesn’t exist. After the call the rep promised to call the director of pharmacy for the medical center who set up this ingenious plan of limiting my rights that I pay a premium to receive and am being denied. But as of yet, no call back from insurance company but did receive a call from the director of pharmacy at the medical center the day before Thanksgiving. I went over all the same points of contention and received the same stonewalling towards the end of a 2o min or so conversation she asked when my next ap
t was. I
told her it was on Dec, 8. My Rx was filled that day but WITH A 2 HOUR WAIT, never had to wait more than 1 hr prior to this time. This DID coincided w/ hitting I-95 rush hour perfectly though.

To end this I cannot say how disappointed I am in being put off despite pointing out direct and seemingly in controversial proof of my rights under Medicare Part D being violated, and secondly the apathy of those patients out there who are taking it on the chin and do not fight back. We cannot wait for ‘something’. I don’t need to tell anyone here this but still, I am continually dumbfounded by all the comments on advocacy sites and comments sections following news columns and online news clips that say why isn’t someone doing something about this?!?! HELLO, STEP UP TO THE PLATE FOR CHRISAKE.

I am still in disbelief. I don’t expect much from an insurance company as I was in litigation w/ one for 4 years to get a settlement over an auto accident that their client was clearly at fault BUT over rights for the disabled, supposedly backed up by the Federal Govt? If I dont receive some satisfaction, and I am not one for big conspiracy theories, but am left w/ nothing more than the idea that there has got to be some kind of collusion going on here to shut down treatment of pain. Possibly as part of an overall reduction in spending in regards to medical care. I have witnessed this in having to fight for 7-8 other medications, most NOT controlled, that are listed in my formulary,but I have been denied coverage for. Eventually they have been approved but not w/out spending hours on the phone w/ doctors, pharmacies, insurance company myself, not to mention the paperwork the doctors must fill out.

IF anyone has any success stories about their grievance procedure I would love to hear it as at this point I am thinking I have just made myself a target and will have a harder time getting meds now than ever. I go for my next appointment and attempt to fill on Monday so hopefully all will go well. I shall give an update on this thread once I hear back from CMS,

Got this in the mail today…

This outfit is apparently working out of Canada  – at least that is the mailing address on  the form..

Also in the “fine print” above where the signature is required of the pt.. it states that your prescriptions will be filled in India, China or Somewhere in Europe.

The medications that are sending out are not approved by our FDA.. I can’t tell you all the horror stories I had read about of Europe’s wholesaler distribution system for medication.. as well .. as the horror stories about the amount of fake medications coming out of China as well as .. a number of Pharmaceutical Manufacturers failing to meet Good Manufacturing Practice in India by our FDA.

The Diversion Investigator position is a core series position within the DEA.  Diversion Investigators enforce the Controlled Substances Act (CSA) and the Chemical Diversion and Trafficking Act (CDTA) regarding the manufacture, distribution and dispensing of legally produced controlled substances and listed chemicals in order to prevent diversion of controlled substances and listed chemicals into the illicit market, while ensuring an adequate uninterrupted supply of pharmaceutical controlled substances and listed chemicals to meet the legitimate medical, commercial and scientific needs of the public.

The following duties include:

  • Conduct a full range of complex investigations, including pre-registrant, scheduled, security, and compliance (i.e. public interest, civil, or criminal) within the regulated pharmaceutical and chemical program.
  • Conduct investigations to ensure compliance with the CSA and its implementing regulations involving the procurement, manufacture, distribution, security, and record-keeping activities of the pharmaceutical and listed chemical regulated industry.
  • Collect and analyze information and evidence; conduct interviews and prepare reports, and present findings and recommendations for regulatory, civil, and/or criminal actions.
  • Research and prepare a variety of written materials and reports which support possible administrative, civil, or criminal proceedings; answer both routine and technical correspondence and telephone inquiries; provide expertise and consultation to divisional personnel and provide guidance to other State, Local, and Federal Investigators.
  • Develop and maintain working relationships with Federal, State and Local agencies in order to promote information and intelligence collection exchanges.
  • Plan, implement, and participate in multi-jurisdictional special programs impacting the diversion of controlled substances and chemicals from legitimate distribution; evaluate the results of investigations and the registrant’s input and prepare corresponding statements setting forth the alleged violations

THE BRONX – Police are searching for the man who slashed a Rite Aid manager right in front of customers.

Investigators say the suspect demanded money at the Westchester Avenue store at around 2 p.m. Thursday. When the manager refused, the suspect slashed him.

The 47-year-old victim is now in stable condition at Lincoln Hospital.

I’m not comfortable being a Pharmacist ?

We now have Pharmacists “not comfortable filling”  C-V’s ?

I have had to move for my job around the DC metro area, over to the Maryland side instead of the VA side. But I kept my doctor on the VA side because he’s good.

I do not get prescriptions for pain. I do use a medication like Lyrica to treat widespread body pain that is mysterious.

I have been filling this same prescription every month for 5 years with CVS — wherever I was in the country.

Today I went to Store 1416, where the “pharmacist” Trinh Tran, sayid she was uncomfortable filling my prescription. I asked her why and she initially didnt say any thing. I and I again asked “Why on earth can’t you fill it?” SHe said that because I live in Maryland (and she assumed my doctor wsa also in MD), I should get the prescription filled at a place closer to my home.

Once I pulled out my doctor’s business card, showing he is 5 minutes down the street, she held on to her “I don’t feel comfortable filling this”. I can’t be on the ‘list’ of pain medication abusers….I don’t use them. The only other factor is that she was discriminating against me for having a disability. And the ADA covers this”

I am a real doctor. They had no idea. Ms. Tran, and “Manager” (who looked about 21) Ms. Reed, you can prepare to have your licenses revoked.

If you had TOLD ME A REASON, even if I didn’t agree with it, I may not have taken the action I’m taking. But this is no different than Black people being inferior to white people. It’s ludircous, not supported by science, and your not filling my legitimate prescription I fill EVERY MONTH at CVS with NO CAUSE is going to cost you. It’s OK that you wouldn’t give me your employee numbers — I found them. Your company, the DEA, and the state of VA will not hear the end of this.

And I have 400 people ready to go in on a class action lawsuit…that would be even more fun, putting non-doctors out of the way of real doctors.

I went to a CVS 10 minutes from you and they filled it with a smile. What your problem was, is, and will always be, is none of my concern….you could have caused me great harm if I didn’t get my medication before the morning.
