Officer Aaron Lorton is among the police who have been called to the Excel Center after Kincade told school security he has a gun in his backpack. While that’s a lie, police do find a pocketknife, so they give him a trespass warning and ask him to leave.

As Kincade starts moving, that’s when Davidson is run over.

“It’s clear to us that the whole use of force in this case could have been avoided just by different positioning, by offset positioning, by moving out of the way, by not standing where he was standing,” said Police Chief Patrick Flannelly Tuesday.

Flannelly said after an internal review of the incident, he and six other members of the command staff unanimously felt Davidson used both conduct unbecoming an officer and an excessive use of force and should be fired.

On appeal, the five civilians on the Civil Service Commission lessened the punishment, demoting him in rank to officer and giving him 30 days of suspension without pay.

Mayor Tony Roswarski said Tuesday while he respects their decision, he fully supports the LPD recommendation of termination.

Is this what is becoming a sort of “diplomatic immunity” for law enforcement ?  Time for someone to take a early retirement ?

  1. @Starwood500 I’m not condoning what the officer did. While I do know several city officers through my volunteer work at one of the high schools, I don’t know this officer. The incident occured back in October and the officer has already served his suspension and has been back at work for some time. I posted another link for you.The actual dash cam video according to our paper is 33 min. Only 1-2 minutes is whats being released publically,several have said it doesnt show the whole story. IMHO this was probably a compromise and if the officer is receiving counseling they can’t say due to HIPPA regs. http://www.jconline.com/story/news/2014/05/22/lpd-officer-discipline-documents/9466959/

  2. How could he be feared by those with guns,traders, cuffs, and assistance? Where is the training for professionals? Glad he had community support because he obviously didn’t have sense to move his foot. Imagine he will retire from his injury that we paid the bill for. I am for police safety and supporting when they have common sense.

  3. This is my hometown. It came down to 1) ‘victim’ has a prior history of instigation 2) I think the civil service commission’s decision came down to yes the cop may have overreacted, he should have moved his foot out of the way (if you watch the entire video) and whether or not the victim deliberatly rolled his very heavy electronic scooter over the cops foot and they saw it as a reflexive action. He claimed he ‘didn’t see him” but he looks like he’s looking right at him as he starts going forward. There was a rather large number of residents in this city that came out in support of this officer. Until this incedent, he had a good reputation in the community

  4. Looks like some cops have too much time on their hands. I’ve known some good cops and not so great cops that told me that job gets old and its hard dealing with some people, but this was uncalled for.One good friend of mine that decided to be a cop told me it gets bad when people who don’t take a bath for weeks and Cops have to handle and cuff these nasty people. He was searching this guy he arrested ,he put his hand in the back pocket of a guy and was stuck by a syringe the guy was using to shoot drugs . This guy my cop friend was arresting for drug dealing was HIV positive and had Hepatitis C. After 6 months of taking certain medications to prevent being HIV positive and getting Hepatitis C he came out clean, but has to be checked ever year now. I saw the amount of medications he had to take and there was 12 bottles of different scripts he took for 6 months, that alone is not good for a persons liver. Cops have a hard job as do Firefighters.
    No matter what were going to have some bad cops, the lure of easy money has a very strong appeal.
