No Charges for Cops Who Disfigured Toddler with Grenade During Negligent Drug Raid

During the raid one of the uniformed men, tasked with caging people for possession of substances the state deems illegal, threw a stun grenade into the crib of 19 month old Baby Bou.

The raid was then justified by the Habersham County police despite Wanis Thonetheva, the man they were looking for, who didn’t even live at the house, not being there and no drugs or weapons being found.

Habersham county actually started up a Facebook support page after this brutal display which featured repulsive comments from apologists, claiming that it was the parent’s fault their child was blown up by police because they were staying with “drug addicts.”

Instead, they defended their negligence by stating that they couldn’t have done a thorough investigation prior to the raid because it “would have risked revealing that the officers were watching the house.”

In the 16 page report presented by the grand jury on their findings, they found that “the drug investigation that led to these events was hurried, sloppy, and unfortunately not in accordance with the best practices and procedures” and that “the zeal to hold them [drug dealers] accountable must not override cautious and patient judgement.” Yet there is still, no crime.

How can their be no crime in breaking into a house and throwing a grenade into the crib of a toddler and blowing his face off? Oh wait, “Because Muh Drug War”!

If this was happening in China, North Korea or some other third world country… As a society… we would be incensed over the HUMAN RIGHTS VIOLATIONS… But since this involves the war on drugs… there appears to be NO HUMAN RIGHTS for US citizens… and no consequences for law enforcement actions.. no matter how or who suffers from their hurried, sloppy investigation !

They fine those who have the money ?

An employee diverts 20,000 units of opiates … doesn’t say how the diversion was made … unless it was calling in Rxs to pharmacies while working at the office..  As insurance companies/Medicare/Medicaid keeps reducing payment for services.. the more ancillary staff that is needed to get the job done.. Prescribers are mostly in exam rooms with pts… employees are mostly directly unsupervised by the DEA registrant/prescriber.  There is no mention of any thing happening to the employee that diverted all those opiate doses.

I guess the employee didn’t have a “pot to piss in ” .. so did the DEA give the employee a “pass” for testifying against boss/prescriber ??

ROGERS, D.O., who practices in Oklahoma City, Oklahoma, has agreed to pay $40,000 to the United States to settle civil penalty claims stemming from allegations that he violated the Controlled Substances Act, announced Sanford C. Coats, United States Attorney for the Western District of Oklahoma.

The Controlled Substances Act, 21 U.S.C. Sections 801 et seq. (“CSA”), was passed by Congress to combat the illegal distribution and abuse of controlled substances, including prescription medications. The CSA is enforced by the Drug Enforcement Administration’s (DEA) Office of Diversion Control, with a mission to prevent, detect, and investigate the diversion of controlled pharmaceuticals and listed chemicals from legitimate sources while ensuring an adequate and uninterrupted supply for legitimate medical, commercial, and scientific needs.

Under the CSA, medical providers registered with the DEA who purchase, distribute, dispense, transfer, or sell controlled substances must comply with inventory and documentation requirements. Regulations promulgated under the CSA require that each DEA registrant, maintain complete and accurate records of each substance manufactured, received, sold, delivered, dispensed or otherwise disposed of by the registrant. These requirements play a vital role in ensuring the appropriate handling, accounting, and distribution of controlled substances.

Violations of the record-keeping requirements subject DEA registrants to civil monetary penalties.

The United States alleged that between January 1, 2012, and February 4, 2014, at least one employee in Dr. Rogers’ office used his DEA registration number in order to obtain over 20,000 dosage units of Schedules III and IV controlled substances which were not for legitimate medical purposes.

It was alleged that Dr. Rogers failed to provide effective controls and procedures against theft and diversion, failed to maintain and review records of the dates, quantities received, dispensation, or inventories of controlled substances purchased using his DEA registration number.

In order to resolve the civil penalty claims against by the United States, Dr. Rogers agreed to pay $40,000 to the government In reaching this settlement, Dr. Rogers did not admit liability and the government did not make any concession regarding the legitimacy of the claims. The agreement allows the parties to avoid the delay, expense, inconvenience, and uncertainty involved in litigating the case.

This case was investigated by the Drug Enforcement Administration’s Oklahoma City District Office Diversion Group and was prosecuted by Assistant United States Attorney Ronald R. Gallegos.

We saw with “opiate pill mills”  owned by person(s) that had no medical background and hiring healthcare professionals to see pts and make a “fast buck”. This was from Alabama .. but is this an example of where they have went and what they are up to ? I wonder if other BOP’s are as on the ball as Alabama BOP’s is ? I hope so… we don’t need a few more NECC out there…

In my last post I told of being abruptly shut out of Walgreens for my Oxy meds, without any explanation and after being a loyal customer for 16 years.

I called the pharmacy manager, at the  Walgreens  I used before moving here, about the ban placed on me last week. She reviewed my file then said it looks like I was banned because more information was required from my doctor!! She said the FL pharmacist (who wasn’t the manager) actually wrote in my file that I am banned so that no other Walgreens would serve me. I told my former Walgreens that the FL pharmacist coldly refused to even tell me why i was banned. The real kicker, is that I actually called FL Walgreens that very morning (before making the 10 mile drive) to confirm that my meds were ready. After checking with the manager, the pharmacy tech called me back and confirmed that they were ready for pick up. However, when I get there a few hours later, the manager and tech are no longer on duty. So the on-duty pharmacist says she doesn’t see anything in my file about picking up my meds. She then says that I no longer fit their criteria (w/o explanation) and I can no longer get served at any Walgreens! The Walgreens pharmacist that I used to use, said that I should call and actually speak with the manager in an attempt to clear this up.

Therefore, I GIVE UP!! FLORIDA YOU WIN!! I thought living here would be the best solution to the cold winter months in the NE. But at least I will be treated by a wonderful caring physician, and hopefully, with the support of the NJ pharmacist, get my file cleared with Walgreens.

Is establishing “corp criteria” .. practicing pharmacy ?.. which the permit holder is not licensed to do ?  Of course, in Florida.. the Board of Pharmacy is stacked with corporate employees.. what do you think the chances of them chastising a chain for practicing pharmacy without a license ?

  Father and son pharmacists Phillip Tuetken and Christopher Tuetken each had their licenses to practice pharmacy suspended by the Iowa Board of Pharmacy one day apart for seemingly unrelated infractions.

      Christopher Tuetken owns several drug stores in the area, including Long Drug in Monticello and Wyoming Drug in Wyoming. As part of the pharmacy board’s decision, he was ordered to sell all of them by Dec. 1.

His license to practice pharmacy was suspended for one year, and he was forever prohibited from owning or managing a pharmacy or holding the position of pharmacist-in-charge. The order came at an Aug. 27 disciplinary hearing.

      An employee at Downtown Drug in Cedar Rapids, a pharmacy Christopher Tuetken owned and served as the pharmacist-in-charge at, stole at least 18,000 tablets of hydrocodone over at least a two-year period, according to documents obtained from the pharmacy board’s website.

      “I should have known better,” Christopher Tuetken said, adding that he was “caught blindsided” when his trusted employee Chuck Long betrayed him.

“The board has grave concerns about [Christopher] Tuetken’s ability to safely practice pharmacy,” the board’s decision reads. “The evidence demonstrates that Tuetken spread himself entirely too thin, as owner of up to 12 pharmacies at one point. Tuetken’s vast business interests left him unable to manage the day-to-day requirements of being a pharmacist-in-charge at Downtown Drug. This practice of overextending himself seems to have led directly to the majority of the violations here.”

I have heard time and again… BOP’s stating that they will not interfere with how a business operates… when there is complaints of under staffing in the Rx dept…yet.. this BOP took the stance that this RPH was “spread to thin”…

I wonder how many Rx depts have had “unaccounted” 18 K opiate doses and was required to “sell the store”…  I am aware of at least 3 in the last year short more than 18 K … I wonder what would have been the outcome if  it had been a chain or hospital.. that had same/similar issues. ?

CVS Health extends kudos to its pharmacists

CVS Health is saying thanks to its 26,000 pharmacists during October’s American Pharmacists Month for their dedication to serving patients in the company’s retail pharmacies, mail service pharmacies and specialty pharmacies nationwide.

10/08/2014 Rumor on the street is that a few CVS HEALTH employees have consulted an attorney about this contract.. and it seems that they are universally being told NOT TO SIGN IT !

I am not an attorney, but if you already work in a “at-will state”.. your employer can fire you for any reason or no reason.. IMO.. this contract is attempting to put a “fire wall” between the employee and their ability to get regress from CVS HEALTH for violating a multitude of Fed/State laws.  Of course, if this contract is not legal to begin with… it will probably take an employee to take them to court – expending time and money – just to get a ruling that it is not legal.. and CVS HEALTH has much deeper pockets than those employees at the store level.

According to the first page… an employee should be able to completely read AND UNDERSTAND 14 pages in TEN MINUTES …  I tried to read thru these pages and IMO.. anyone who tries to read/understand these 14 pages in 10 minutes… is either extremely bright or a fool/idiot !

I had my own pharmacy for 20 yrs… as well as some other businesses and one thing that I have found in contracts presented to me… generated by them… tend to have one thing in common .. lack mutuality … which means that it grossly benefits the entity that drew up the contact and puts the entity that is to sign the contract at a great disadvantage.

It is common business sense… NEVER SIGN ANYTHING… that was drawn up by an attorney – other than one working for you – until you have your attorney review the contract.

Most contracts are – or should be – mutually agreed upon terms… There have been a number of times that I have walked away from a contract… because the terms of the contract were NON NEGOTIABLE !

Increasingly my inbox is like a BOX OF CHOCOLATE  you just never know what is going to show up …

It now appears that CVS HEALTH is changing their contract with Pharmacies .. that if the pharmacies don’t stop selling tobacco products.. they will “fine” the pharmacy’s patients FIFTEEN DOLLARS ADDITIONAL CO PAY ON EACH RX FILLED. Which will put a major dent in a Pharmacy’s profits.. if they can even stay afloat.

There has been a lot of talks about  Islamic State, formerly the Islamic State of Iraq and al-Sham (ISIS)  lately in the news.. especially after they have BEHEADED three innocent civilians and posted the beheading on www.youtube.com. What has been stated about ISIS’ philosophy is “convert to ISLAM or DIE ” !

Seems like CVS HEALTH has developed a similar philosophy … “convert to our philosophy or we will KILL YOUR BUSINESS ”

IMO.. whoever thought this up has loss all their marbles

Imagine that… people who abuse controlled meds… ALSO abuse alcohol … a little fact that seems to be left out of published stats… about ER visits caused by substance abuse…  ALCOHOL is consider a DRUG.. just not a controlled drug or a opiate..  I know that must have been a oversight by those issuing press releases supporting the war on drugs.
