Judge dismisses ID theft lawsuit against pharmacies

A Sewickley lawyer cannot impose a legal obligation on CVS and Giant Eagle pharmacies that doesn’t exist in law, a federal judge ruled Wednesday in dismissing a lawsuit seeking to hold the pharmacies responsible for identity theft.

Andrew Gabriel sued the retailers in a proposed class-action lawsuit after someone using his name on fraudulent prescriptions obtained oxycodone at CVS and Giant Eagle stores. U.S. District Judge Joy Flowers Conti granted the retailers’ motion to dismiss the lawsuit.

“A pharmacist’s duties cannot be expanded beyond those imposed by the appropriate legislature and regulatory agencies,” the judge said.

  1. Simple solution. Do not use the any entity associated with either company, its parent and affiliate companies. Profit is their bible so remove the profit and they understand and comply.

    • I did a web search for this “how do I get a fake driver’s license ” and got this many responses 28,300,000 results. If you figure that 99.99 % are fake or duplicate … that would suggest that 283 may well be website capable of producing a “real looking fake driver’s licenses”. Years ago, my state senator was pharmacist… we had known each other since college and we had out own independent pharmacies in adjacent cities.. He had a fairly small district and pester the hell out of him to get the state driver’s license motor bureau to set up a 60-90 day trial in the 10 or so pharmacies for pharmacies to be able to validate driver’s licenses present were valid in the state’ database… looking them up by the driver’s license number and just get a idea of how many fake/false driver’s licenses are being presented and just make a copy of the fake/forced licenses – no legal action to be taken during the trial period.. never would even discuss it… WHY?… if nothing else.. it would prove that the state’s driver’s license template had been compromised… and the state knowing this. would have to create a new template and issue new licenses. There are a few digital face/finger print prgms that could be used by the state and or pharmacy or healthcare in general … the post you commented on was 7 yrs old and since the vast majority – if not all – controlled med Rxs are transmitted electronically, which greatly hinders people from creating forged or altered controlled med Rxs

  2. Once again, there is a simple, on line, real time solution to this problem. It appears that the regulators do not want to implement it.
