A colleague needs your help !

I received this email from a fellow Pharmacist. What this Pharmacist did… during a slow period… went to an adjacent room to the pharmacy… to take an employer mandatory video training session. That was two years ago, when according to this Pharmacist, the practice act permitted such… Now the BOP is taking this Pharmacist license to task with the current law which appears to be different than it was two years ago. If you have a older hard copy of Michigan practice act or a older electronic copy… let me know steve@steveariens.com and we will help this Pharmacist outsmart the apparent “back-handed” tactics of this BOP !

Low and behold last week I received allegations against my pharmacy license from the Michigan dept. Of Licensing.
I was DEFINITELY wrongfully terminated. I let all that go and just moved on.
Now, I need a copy of the michigan Board of Pharmacy Admintrative Rules.
It must be a Hard Copy though. Reason being the online electronic version has been changed since I have been fired.
 The rule I need is the one pertaining to if a pharmacist can leave the pharmacy (The Box) not the building.
The michigan law has always been a pharmacist can’t leave the “facility” and that is what us michigan pharmacist live by. Just in under 2 years this rule regarding the pharmacy must be in our persons, charge and us not to leave the “facility” has been rescinded.
It’s gone! Poof!
This is why I need a hard copy of the Administrative Rules.
It was in there on the Electronic version as of 2/23/2013
But now it’s gone.
Michigan pharmacists don’t know this either. We all still go to the bathroom, grab a water , walk around in the store thinking it’s ok.. Little do they know it’s not ok anymore.
So now I’m having to hire a lawyer to fight these infractions against my liscense. I was on film leaving the pharmacy “box ” . It was a big box store so you are on camera when you pick your nose.

  1. Michigan is one state probably overwhelmingly micromanaged from who knows where. No death penalty there. I understand about lunch breaks and restroom stops. In Fresno, my pharmacist is from Nigeria. He may claim a interpretation issue. Now he has one Sr. Tech and 2 delivery drivers and 2 other tech “trainees”
    That’s 5 techs to one pharmacist. Against the technical rules. He also confided in me that once he was licensed, no longer was updating his skills a issue. That’s okay with me, but I count all my meds and idenify them beforehand. He is doing fine at $125,000.00 per annum. Closed at 6pm, also weekends and holidays. And it doesn’t bother me at all he cannot pronounce methylpredniselone

  2. I have a hard copy of Michigan regulations from 2001. It defines “pharmacy” as a building or part of a building where the practice of pharmacy is conducted. I do not seem to have the administrative rules from that period though.

      I tried the law library in my town Cooley Law Library by Oakland University.
      No luck there
      Found a copy in The Baker College Library 2007 copy.
      Which states “we are not to leave the Establishment”
      Which I interpret as the building.
      Not the box.

  3. Was the adjacent room under what was considered the licensed area of the pharmacy at that time?? Its like someone drinking when the drinking age was 18 then changed to 21 so now theyre going go back to get you for drinking underage. Seriously there should be a statute of limitations. Who filed the complaint?

  5. Does Michigan publish all laws plus rules and regs for the legislators. If so there could be a copy of the pharmacy act in those books. Those could be available from a legislator, representative or senator. Also, they might be available from a law library. Any have a kid in law school.

  6. That’s just crazy! My husband and I are both Michigan pharmacists and were not notified by the BOP that this change was made. It’s bad enough that pharmacists have to work a 12 hr shift without having a lunch or dinner time but now the BOP is rescinding licenses for leaving the pharmacy??
