More guilty until proven innocent with the DEA?

DEA seizes Tampa pharmacy’s drugs, gets sued

— The owners of a pharmacy on Race Track Road say the Drug Enforcement Administration seized all its controlled substances and is illegally interfering with the drug store’s ability to do business.

RS Compounding, which does business as West Chase Compounding Pharmacy, filed a lawsuit against the DEA, the Justice Department and Attorney General Eric Holder and asked a judge to issue a restraining order to allow the business to continue operating.

A federal judge has scheduled a hearing for Tuesday afternoon.

DEA spokeswoman Mia Ro declined comment on the lawsuit.

“The basis for DEA’s action was not that the pharmacy posed some imminent harm or threat to the public,” court filings state. “No, the DEA’s justification was that a membership interest in the pharmacy was transferred some 19 months before without its approval. The DEA acted unlawfully, outside its statutory and legal authority, and contrary to its prior interpretation of its own regulations. Further, the DEA violated the Pharmacy’s constitutional right to due process by circumventing its administrative process.”

There is no mention of the BOP of taking action against the Pharmacy’s permit.. was that just omitted or does state law require EVIDENCE in order for the BOP to act ?

  1. This is the craziest bunch of crap I’ve ever heard and 3 years from now we will look back on this and think what the hell where they thinking. The DEA and other entities are going way too far playing parts they know nothing about and making fools out of themselves.

    Its not just about opioids anymore, a pharmacy like this compounds special medications for people that need medication for cancer to a certain milligram, not all cancer is the same and needs to be made special for that cancer patient ,it has to be compounded to their doctors orders. And these idiots are holding up not just people with chronic pain but people who need certain cancer medications compounded to their need.

    How much further does this need to be taken.
    I hope the DEA and whoever else pays the price for screwing with the lives of people that may have just a few weeks to live.

    Look how bad they screwed that up millions of people trying to gain access all in the same day. Common sense is sound practical judgment derived from experience rather than study, this alone would have told certain people to access the website on certain days instead of the entire Country all at once,,,,IDIOTS.

  2. If I remember, it is the BOP approves the transfer of the pharmacy license from one ro another. If controlled substances are involved, the pharmacies transfer inventory via rhe DEA-222 forms between the pharmacies POAs if stock is not rerurned or destroyed…and then the board comes in and does rhe imspections, and the closing pharmacy license and CSR is retired. It the simplified version, but did I miss anything…so the DEA butted in on this because????……..and 19 MONTHS AFTER???????? Honestly I do not ever remember the DEA EVER physically being invovled in ANY pharmacy transfer, opening or closing decisions. That is all state boards….

  3. This is so wrong. Even though the state is different Tennessee is encouraging pharmacies to report doctors and investigating the top pharmacies for pain medication. Simply discrimination. Hoping that this judge is honest and caring. Wouldn’t hurt if he had a family member suffering. Thanks for your reporting. This witch hunt should stop.
