Town of Burlington woman convicted on all counts in drug overdose death

Fitzgerald, of the Town of Burlington, is accused of selling the drugs to Buchholtz that investigators contend caused his fatal overdose. Buchholtz’s body was found on Aug. 19 on the floor of his bedroom.

During closing arguments on Thursday, defense attorney Lori A. Kuehn said Buchholtz, 53, an unemployed truck driver, was a drug addict who had more than one dealer, and drugs that Fitzgerald sold to him the week before he died couldn’t have caused his death.

Kuehn told jurors that Buchholtz was overweight, had hypertension and an enlarged heart, developed a tolerance from abusing drugs and didn’t have lethal levels of the drug in his system.

But Racine County Assistant District Attorney Sharon Riek said Fitzgerald’s drug sales to Buchholtz led to his fatal overdose.

I guess if you are going to sell drugs.. you shouldn’t do it in a small town (pop 10.5  K) like Burlington, WI.. To convict a person of reckless homicide… of a know drug abuser, with a multitude of health issues and whose BLOOD LEVEL WAS LESS THAN LETHAL !  They say that justice is blind.. doesn’t say anything about it being influenced by phobias of the jury or judge …
